apparently this thread forked for some reason... Maybe we should bring it back as a single one on community. For this reason, I CC'ed community@OW.

I'm not sure you received my comments on local regulations. I have good reasons to think that Sun's licensing provisions wrt to the prohibition of implementation may not be 100% valid in Europe or Asia -- or at least, that someone may argue azgainst them. As for LGPL + sun licenses. The LGPL explicitely prohibits the (re-)distributor(s) of the work or of derivative works to restrict the redistribution rights. However, the "certification" applies to a *binary*, whereas LGPL first applies to source code. This means that legal workarounds may be found, as long as the copyright holders agree on them.

Anyway, I think this question deserves a broader discussion, because the answers may be a little intricate.

Yes, I got wind of this novel legal theory recently.  Personally, I find
the scheme rather repulsive.

The problem with this is that the redistribution privileges granted by
the LGPL (or BSD) appear to be overridden by the licensing requirements
claimed by Sun.  That is, people who download even a TCK-passing JOnAS
might be legally threatened into not exercising some of their LGPL
privileges.
